The Labour Appeal Court allowed the employer’s appeal and overturned the order of Shaik AJ in the Labour Court.  In terms of the Employment Equity Act 55 of 1998 affirmative action measures are aimed at the advancement of designated groups.  The national selection panel disregarded the recommendation for an appointment of the provincial selection panel.  Another candidate was appointed and the applicant argued that there was unfair discrimination based on race.  On the evidence it was proved that the appointment of the successful candidate advanced service delivery and had more operational experience.  The employer’s decision gave effect to its employment equity plan.
