Management restructured the business operations and invited employees to apply for positions in the new structure. Some employees failed to do so and were then dismissed for a reason based on operational requirements. Apart from the dismissal being fair the employees forfeited their right to severance pay in terms of s 41 of the BCEA because they had unreasonably refused to accept an offer of alternative employment [BCEA 41(4)].
